Introduction

According to the relevant definitions there can be an indirect commercial use. That means that by means of a publication of an institution in the internet a commercial purpose is pursued to increase the publicity for winning more customers. A commercial purpose does not only include a direct distribution, but also indirect benefits.

We assume that each company wants to attract customers and generate revenues. Therefore we assume that each company has commercial purposes and thus wants to use Contrexx commercially. The revenues of the Contrexx licenses ensures the quality and development of Contrexx.

Usually clubs and individuals without commercial purpose are entitled to use Contrexx Opensource.

Commercial versus Non-Commercial

Question

How do define commercial or how can I know that I need a commercial license for the use of my Contrexx license?

Answer

  • Non-commercial are all companies whose motivation and purpose is not of a commercial nature, i.e. which are not run to make profits.
  • Commercial are all companies whose motivation and purpose is to make profits.

Differences: Commercial / Non-Commercial

Question

Are there any differences between the free of charge Open Source version and the Standard version which is liable to costs?

Answer

In regard of the functionality of the existing modules there is no difference. But it can be that some of the modules are only available for the version which is liable to costs. A good example is the "Shop" module, which is not included in the Open Source version, because it is intended for commercial use.

Associations

Question

Are associations commercial?

Answer

By law, associations are non-commercial and may not not be "profit-motivated". If they are profit-motivated anyhow, the government can demand to change the legal status. A certain cash-flow exists in nearly all associations and is not illegal.

Firebrigade

Question

May I use Contrexx for the website of our firebrigade?

Answer

If it is a voluntary firebrigade, i.e. not a professional firebrigade, the use of Contrexx free of charge is no problem.

Communality

Question

May I use Contrexx for the website of our communality?

Answer

No, for the usage as communality page a commercial license is required. Exceptions can only be made, if the website is made on a voluntary, private basis form one of the inhabitants. The relevant website must be declared as "non-official" and may not get any subsidies from the communality.

Teacher

Question

May I use Contrexx to provide the pupils of my classes and courses with files, which can only be downloaded per password.

Answer

Yes, but especially for schools and universities a special version which corresponds to Contrexx Premium is available as very economic Contrexx Education license.en:FAQ:Licenses
